Sheriff’s Sale Process When Third Party Buyers Purchase Sales
Requirements for Purchasing a Sale

  1. Deposit requirements have changed. If judgement creditor is the purchaser of the sale, a deposit it not required. Third Party Buyers must make a deposit as follows:
    If the appraisal value of the property is:
    $10,000 & under, the deposit must be $2,000.00
    $10,001.00 – $200,000.00, the deposit must be $5,000.00
    $200,001.00 & above, the deposit must be $10,000.00
  2. Buyer beware that he/she is responsible for any and all outstanding costs.
    Anyone who purchases a Sale, must provide (but not limited to) the following information: name, address and telephone number. Click on Real Estate Purchaser Information Form for Third Party Buyer [Word format or PDF format] to be completed at the time of Sale.
    Note: When using PDF format, a completed form cannot be saved on your computer. Please fill in and print for your records.

Paying Balance Due after Purchasing a Sale

  1. The Third Party Buyer must pay the balance due within 30 calendar days from the Confirmation of Sale.
    Note: Our office will call the Third Party Buyer notifying him/her when balance is due.
  2. Third Party Buyer may be required to submit a check made payable to the Tuscarawas County Recorder for the recording fee and a check made payable to Tuscarawas County Treasurer for the conveyance/transfer fee (unless the fees are included in the confirmation). The Sheriff’s Office will advise you in advance if you are required to pay either/or both of these fees.
  3. Proceeds from the balance will be used to pay owed real estate taxes prorated to the sale date.
  4. The Third Party Buyer will provide a completed Deed Conveyance Form when paying off the balance due. Please contact the Civil Division at 330-339-2000 in order to obtain a copy.

Recording Deed of Sale

  1. The Tuscarawas County Sheriff’s Office must record the Deed of Sale within 14 business days from the date the Third Party Buyer paid the balance due.

Mailing Recorded Deed of Sale

  1. The recorded Deed of Sale will be mailed to the address provided by the Third Party Buyer.
