The Marriage License bureau of the Tuscarawas County Probate Court is located in Room 104 of the old courthouse on the public square in New Philadelphia.

Our hours are 8 a.m. to 4 p.m., Monday through Friday, except for government holidays. Our telephone number is 330-365-3231.

The lawful age to obtain a marriage license without parental consent is 18.  A marriage license will not be issued to a potential groom who is under 18. However, if the potential groom is at least 18 years of age and the potential bride is 16 or 17 years of age, they may apply for a marriage license. Please contact our office for all of the special requirements, including pre-marital counseling, related to a minor marriage license.  Blood tests are no longer required. In most instances, the couple will receive their marriage license at the time they apply. Once issued, the license is good for 60 days. A marriage license may be issued to a couple who reside out of state but who are getting married in Tuscarawas County. For county residents, the license is valid anywhere in the state of Ohio.

Both applicants must apply together in person. If the couple is not from out of state, at least one party must be a resident of Tuscarawas County in order for the license to be issued here. The Court requests that applicants bring the following documents when they apply: photo IDs, certified copies of birth certificates and Social Security cards or other documents (such as a paycheck stub or tax return) that contain each person’s number and name. If any of those documents are not presented, the matter must be referred to the Judge and she will decide whether to issue a license.

If the couple is from out of state, their out-of-state IDs will suffice. If one of the parties is a resident of Tuscarawas County and his or her ID does not have the current address on it, the Court requests the person bring proof of his or her address, such as a bill. If that documentation is not presented, the matter must be referred to the Judge.

If either party has been divorced, that party must provide the date, case number and location of his or her most recent divorce in addition to the name of his or her prior spouse and any minor children. The easiest way to provide that is with a copy of the divorce or dissolution decree signed by the judge that ended the marriage or a certificate issued as a result of the marriage being terminated. If that information is not presented, the matter must be referred to the Judge.

Cost for a marriage license is $70 cash. We are not permitted to accept checks, credit cards or debit cards. The fee includes one certified copy of your marriage certificate, which will be mailed to you after your marriage is recorded.

To obtain a certified copy of your marriage record, please call (330) 365-3231 and a deputy clerk will assist you. The cost for a certified copy is $3.

Only a duly ordained or licensed minister who is registered with the Secretary of the State of Ohio, a Judge, a Mayor, or the Superintendent of the State School for the Deaf may solemnize a marriage.
